This Terms Of Service ("Terms") governs the terms of use by all members using services offered to them by TrafficExchange101.com ("Provider"). Make sure that you read through the terms carefully.

Member agrees to receive access to Provider's services according to the following terms and conditions:

I understand that I use this service at my own risk and that it is presented as-is with no warranty or guarantee of any kind.

I agree not to hold the provider liable for any damage that may occur to me, my customers, or anyone involved as a result of using this service. I am solely responsible for anything that may occur as a result of using the provider's service.

I understand that at times inappropriate sites may appear as pop-unders on my site from time to time as a result of people abusing the provider's system. I agree to inform the provider when these sites appear so that they may be quickly removed from the provider's program.

I agree not to place my site under an inappropriate category.

I agree not to post to the provider's program any URLs that contain any of the following: adult or pornographic materials, excessive profanity, illegal content of any sort (according to United States law - including but not limited to "warez," child pornography, content showing people how to conduct illegal activities such as hacking, passwords or serials for commercial products), defamatory content of any kind, seditious writings, libel, hate propaganda, racist or otherwise discriminatory content, tools or instructions for "spamming" of any kind, or anything else which common sense may dictate as unacceptable for general consumption. I agree that I am personally and professionally responsible for any damage that may occur as a result of the content I promote using the provider's or my violation of this covenant. I understand that the purpose of this covenant is not to censor any content, but to prevent any damage or offense from occurring as a result of using the provider's program or as a result of someone viewing my site content.

I agree that the provider's program is the sole arbiter of what sites are deemed acceptable for the provider's program and that the provider may remove my site from the program without warning or explanation.  (Please note that the provider will always endeavor to communicate to you our justification if your site is removed.  Usually, only in extreme and obvious cases of abuse would we remove a URL without notice to the owner.  In the most extreme cases we may be forced to involve law enforcement and/or the Internet provider of the hosted site.  Again, this clause is here to protect you, your viewers, and the provider from predators and abusers of this system.)

Enrolling other members is prohibited:
Members are not under any circumstances allowed to sign up other members. Members may refer other individuals to the website and help them through the sign up process, however the individual must complete the signup process by him/herself, including the reading and agreeing to the Terms of Service. Furthermore, no member shall create false accounts simply for the benefit of referral rewards or to create a manufactured downline. Any member found to be engaged in such activity will have their membership revoked and will lose all credits in all accounts created whether earned or purchased.

I agree not to promote the provider's program with any form of "spam" or advertising that is generally considered abusive or unacceptable by the Internet community as a whole.

I agree not to use the provider's graphics or logos in any way except where expressly given permission to do so. I may express my creative freedom in promoting the provider's program, but if I stray from the promotional materials provided, I shall not use the provider's graphics or logos in such promotions unless given permission to do so.

I agree not to post, express or write defamatory or negative comments about the provider's program in any way shape or form.  I understand that all communications with the provider's staff are strictly confidential.

I agree not to post my startpage url in any way. (ie. other Traffic Exchanges) in or order to gain unearned credits. I agree not to place startpage url into and autoclicking program. Violation of this will result in the immeadiate suspension of your account. This is here to keep cheaters out and get your opportunity seen by others.

I agree that the information I am using to sign up is valid, factual, and in good faith.  I agree not to sign up using a false name, fake/invalid email address or alias of any sort and that doing so constitutes an act of fraud.

I agree to receive emails from the provider which may contain updates to the providers service, special promotions, and/or messages from the providers sponsors and advertisers. The provider will send no more than 3 emails per week.

Information provided to the provider will never be provided to any 3rd party - unless you give express permission to do so. We respect your privacy and do not partake in the practice of selling customer information for any reason. We will never use your personal or business information in any way that violates your privacy. When you provide any information to us, it will only be used in such a manner as has been made clear to you, with your acknowledgement and permission.
